Nudity of female upper body shouldn’t be regarded as sexual or obscene by default: Kerala High Court

New Delhi, June 7

Kerala High Court on Tuesday observed that the depiction of a woman’s naked body should not be regarded as sexual or obscene always.

As reported by Live Law, the High Court made this observation while while discharging a mother from a criminal case pertaining to making a video of her children painting on her semi-nude body.

She was chargesheeted for offences under under Sections 13, 14, and 15 of the Protection of Children from Sexual Offences Act, 2012 (POCSO), Section 67B (d) of the Information Technology Act, 2000 and Section 75 of the Juvenile Justice (Care and Protection of Children) Act, 2015 (JJ Act).
