Haryana Govt Circular on Republic Day celebrations mentions yet to be notified 5 places as Sub-Divisions: HC Advocate

Hemant Kumar, Punjab, and Haryana Advocate pointed out that the recently issued Haryana Government’s circular on Republic Day celebrations mentions five places as Sub-Divisions which are yet to be officially notified.

Hemant said that during the past couple of days, two successive Circular letters have been issued by the Political and Parliamentary Affairs Department of the Haryana Government, which comes directly under the State Chief Secretary, about a detailed program of official functions concerning the unfurling of National Flag by the Governor, CM, Dy CM, Ministers, MP/MLAs of the ruling party/coalition and certain Chairpersons of Zila Parishads on the occasion of 74th Republic Day on Jan 26, 2023, at 79 different places across the State, which have been referred to as Sub-Divisions in such Circular letters.

However, an Advocate at Punjab and Haryana High Court, Hemant Kumar, pointed out that as of date, there are only 74 Sub-Divisions in the State of Haryana. In other words, five places viz. Bawani Khera (Bhiwani district), Manesar (Gurugram district), Julana(Jind district), Nilokheri(Karnal district), Nangal Chowdhry(Mahendragarh district) which have although been mentioned as Sub-Divisions in Haryana Govt Circular Letters and where specified MLA would unfurl the National Flag on the occasion of Republic Day, are yet to be officially constituted as Sub-Division by the State Government.

“Although it has been over 4 months since CM Haryana Manohar Lal Khattar on Sep 6, 2022, tweeted the announcement of 8 new Sub-Divisions in the State which apart from the aforementioned 5 places also include Israna(Panipat district), Kalanaur(Rohtak district) and Chhachhrauli(Yamunanagar district). Interestingly, the name of these three is not included means mentioned as Sub-Divisions in the Haryana Govt Circular letters dated 21 and 22 January,” the Advocate noted.

“To date, requisite (Gazette) Notifications in this regard i.e. formal and official constitution of the above 8 newly announced Sub-Divisions are yet to be issued by the State Government for reasons best known to the concerned authorities. He said that the Notification for the constitution of a new Sub-Division is issued by the Administration of Justice Department in the State of Haryana under provisions of Section 7(3) of the Code of Criminal Procedure (CrPC) after consultation with Punjab and Haryana High Court, Chandigarh. Now one wonders if in the next two-three days before January 26, 2023, i.e. 74th Republic Day, the aforementioned newly announced Sub-Divisions are officially constituted and notified as such by the issuance of requisite Gazette Notifications by the Haryana Government,” he added.
