Haryana Chief Secretary Issues Instructions on Reservation for Persons with Disabilities in Promotions

Haryana Chief Secretary, Sanjeev Kaushal has issued detailed instructions regarding reservation for persons with disabilities in Group A, B, C, and D posts. The instructions pertain to the Grant of Reservation in Promotion to the Persons with Benchmark Disabilities (PwBDs) under the Rights of Persons with Disabilities Act, 2016.

The Rights of Persons with Disabilities Act, 2016, came into effect on April 19, 2017, replacing the previous Act. Previously, the benefit of reservation in promotion at a rate of 3% was granted until April 18, 2017. Consequently, the instructions for 4% horizontal reservation shall be applicable starting from April 19, 2017, which is the date when the 2016 Act became effective.

The instructions state that the reservation will be applicable to PwBDs who have a disability of 40% or more in the categories covered under the Act. The reservation will be implemented through a 100-point roster. The points used in the roster after a gap of 25 points will be used to give reservation to PwBDs.

The instructions also state that if a PwBD is in the zone of consideration for promotion against a general vacancy, they may be promoted against the general vacancy, if there is no suitable PwBD candidate available for promotion against the reserved vacancy.

Applicability

The instructions are applicable to PwBDs who are covered under the Rights of Persons with Disabilities Act, 2016. The Act covers various categories of disabilities, including blindness, deafness, locomotor disability, and intellectual disability.

Quantum of reservation

The reservation in promotions will be 4%. This means that 4% of all promoted posts in Group A, B, C, and D posts will be reserved for PwBDs.

Method of reservation

The reservation will be implemented through a 100-point roster. The points used in the roster after a gap of 25 points will be used to give reservation to PwBDs.

The instructions allow for exemption from the reservation in certain cases. For example, an establishment may be exempted from the reservation if the type of work carried out in the establishment does not require the skills or abilities of PwBDs.

No denial of promotion

The instructions state that no promotion shall be denied to a PwBD merely on the ground of disability. This means that a PwBD who is eligible for promotion cannot be denied the promotion simply because they have a disability.

Supernumerary posts

In case of PwBDs employees, whether retired or in service on after 19 April 2017, who are found eligible for deemed promotion/promotion, supernumerary post, if necessary, shall be created for limited period, i.e., till the arising of actual vacancy in the cadre. Benefit of promotion to PwBDs person will be allowed if the disabled employee fulfills the conditions for the promotional post as per provisions of the service rules applicable.
