However, the six-year Rajya Sabha tenure of the above three is ending on January 27, 2024.
On January 2, 2024, the Election Commission of India has issued a notification regarding the election of the above three Rajya Sabha seats falling vacant from NCT, Delhi and nominations for this election can be filed till January 9, 2024. 10 Nominations will be scrutinized on January, nominations can be withdrawn till January 12, voting, if necessary, will be conducted on January 19 and after that counting of votes will take place and the election process will be completed by January 23, 2024.
Advocate Hemant said that since AAP has 62 MLAs in the current 70-member Delhi Assembly while BJP has eight, hence once again all three AAP party candidates will be elected unopposed on all three Rajya Sabha seats and there will be no need for voting. This means that the three persons to whom party supremo Arvind Kejriwal will give party tickets as candidates, will be returned by the Returning Officer (R.O.) of the said election on the last day of withdrawal of nominations i.e. January 12, 2024. Will be declared elected unopposed.
Hemant also told that although the elections of Rajya Sabha are biennial i.e. after every two years, but as far as the subject of NCT, Delhi is concerned which is allotted 3 seats in Rajya Sabha, elections for those three seats are held once every two years. Rather, elections are held for all three seats after every 6 years. However, after the formation of NCT Delhi Assembly in December 1993, from January 1994, elections for all three Rajya Sabha seats are held in the same year but separately. In other words, not one but three separate notifications are issued for the above mentioned three Rajya Sabha seats. Delhi High Court has also justified such electoral system in the year 1994.
However, amidst all this, it will now be worth seeing whether Arvind Kejriwal sends Haryana State AAP President Sushil Gupta to the Rajya Sabha for the second consecutive time or not, since with the general elections of the 18th Lok Sabha in the country in the next April-May 2024, Also, Haryana Assembly elections are scheduled for October, 2024 (or possibly even before that). Now, it will be interesting to see whether AAP Party (Kejriwal) sends Sushil Gupta or any other senior leader from Haryana to Rajya Sabha.

However, despite currently being in judicial custody, there is no legal bar on him contesting the Rajya Sabha elections,” Hemant Kumar said.
