Legal notice sent to ECI for expeditious conduct of bye-election on vacant Ambala parliamentary seat in Haryana

It has been almost five months since Ambala Parliamentary Constituencyin the State of Haryana was declared vacant by Lok Sabha Secretariat due to the demise of then elected M.P. Ratan Lal Kataria ( BJP) on 18 May 2023 however the Election Commission of India (ECI) is yet to take a call on conduct of Bye-Election on ibid Ambala Lok Sabha (LS) seat.

This was expressed by Hemant Kumar, Punjab and Haryana High Court Advcocate.

Hemant Kumar, an Advocate at Punjab & Haryana High Court who also happens to be a registered Elector in Ambala City Assembly Segment falling under Ambala (S.C. reserved) P.C. in the State of Haryana has today 10 Oct 2023 sent a Legal Notice to ECI urging immediate conduct of such bye-election failing which he would invoke the Writ Jurisdiction of Punjab & Haryana High Court in this regard.

Hemant has cited Section 151A of Representation of the People Act (RPA), 1951 (Central Act No. 43 of 1951) which provides that a bye-election to fill casual vacancy including in the House of the People (Lok Sabha) shall be held within a period of six months from the date of the occurrence of the vacancy. Hence in respect of the above vacant Ambala P.C. in the State of Haryana, such Bye-Election should be conducted by ECI well before 18 November, 2023.

Kumar said that recently the ECI while announcing the detailed schedule for General Elections to State Legislative Assemblies of Chhatisgarh, Madhya Pradesh, Mizoram, Rajasthan & Telangana also didn’t announced the schedule for conduct of Bye-Election to Ambala P.C. for reasons best known to it.
